Tortilla Maker El-Milagro Shreds Worker’s Sexual Harassment Suit

Tortilla company El-Milagro Inc. defeated a sexual harassment suit from a worker who alleged she had to seek counseling and anti-anxiety medication because of the conduct of her colleagues.

The conduct the production line worker identified was “undoubtedly inappropriate and distasteful” but failed to objectively rise to the level of severity or pervasiveness that would establish liability, the US District Court for the Northern District of Illinois said Tuesday, as it granted El-Milagro’s motion for summary judgment.
