Top Golf USA Inc failed to pay the legally required minimum wage because of improper tip handling, workers at a Georgia establishment say in a proposed collective action.
The Fair Labor Standards Act allows the Topgolf Callaway Brands Corp. unit to pay less than minimum wage by claiming a tip credit. But the Alpharetta workers say they weren’t given proper notice of FLSA’s tip regulations, and Topgolf improperly pooled their tips to share them with employees who usually aren’t tipped, according to the US District Court for the Northern District of Georgia complaint.
