A North Carolina doctor who performed balloon sinuplasty surgery with used, potentially contaminated medical devices lost her Fourth Circuit bid for a new trial on Tuesday.
Anita Jackson—for a time the nation’s leading Medicare biller for sinuplasty surgery—was convicted of, among other things, holding for sale adulterated medical devices in violation of the federal Food, Drug, & Cosmetics Act.
On appeal, the ear, nose and throat doctor argued that the statute didn’t reach her alleged conduct because she wasn’t holding the devices for sale, but instead holding them for use in patient procedures.
