Tommy John Faces Infringement Suit Over Men’s Exercise Underwear

Pakage Apparel, Inc., sued Tommy John, Inc., in federal court for allegedly violating its patent in a pouch it developed for men’s underwear to be worn while exercising.

According to the complaint filed in the US District Court for the Southern District of Texas Nov. 17, the inventors used their own bodies to develop “an innovative pouch to support their jewels comfortably and securely during exercise.” The design was expanded to swimsuits and board shorts and "[s]upport with fashion became the yardstick by which active men measured their undergarments,” the complaint said.
