Industry group Plant Based Foods Association doesn’t have standing to challenge an Oklahoma law prohibiting meat sellers from misrepresenting products as meat if they aren’t derived from livestock, a federal judge said.
The organization failed to show that its members, including Tofurky Co., which is also a plaintiff in the suit, faced a credible threat of prosecution under Oklahoma’s Meat Consumer Protection Act, because the law only applies to those who sell meat, the US District Court for the Western District of Oklahoma said Monday.
The organizations say the law violates the First and Fourteenth Amendments.
