Theo Chocolate Inc. convinced a federal judge to trim a proposed class action alleging the company failed to disclose heavy metals in its dark chocolate, but the court let most claims against Theo proceed.
California resident Pamela Chesavage and others who said they purchased Theo dark chocolate bars filed the proposed class action suit last year. Their complaint alleges the bars have high levels of cadmium, lead, and arsenic, and they wouldn’t have bought the chocolate had Theo disclosed that. The chocolate maker sought to dismiss the complaint.
