Cinema Entertainment Corp. defeated a proposed class action alleging it shared the video-viewing information of consumers with Meta Platforms Inc. in violation of the Video Privacy Protection Act.

Movie theaters aren’t covered by the VPPA because they aren’t “video tape service providers” within the meaning of the act, Judge David R. Stras said Monday for US Court of Appeals for the Eighth Circuit.

The appellate court affirmed a September 2024 ruling of the US District Court for the District of Minnesota dismissing the lawsuit on the same grounds.
