Texas Winter Storm Price Surge Order Goes to State Supreme Court

The Texas Supreme Court will review an appeals court ruling that a scarcity order issued by the state’s Public Utility Commission during the deadly Winter Storm Uri in 2021 exceeded the commission’s authority.

Oral arguments were set for March 19, 2024.

The Public Utility Commission says the order is needed to prevent another pricing glitch like the one that impacted the state’s electricity market during the storm.
