Hicks Thomas LLP is disqualified from a 17-year-old case in Texas after failing to disclose that one of its legal assistants previously worked on the litigation for the opposing party, the state supreme court ruled Friday.
The prominent Texas firm failed to instruct assistant Felicia O’Loughlin to not work on matters she had been involved in prior to her hiring, the justices said in a unanimous opinion.
“Disqualification is a harsh remedy, but the burden of employing preventative measures to avoid this result is slight,” Justice John Devine wrote.
