Lubbock Heart Hospital LLC was unable to convince Texas Supreme Court justices to review a medical malpractice case related to a pacemaker surgery, after a Texas appeals court ruled that the expert report only had to mention the employee’s actions to support a vicarious liability claim.
Kassandra McQuillen sued the hospital following the implantation of a pacemaker that allegedly caused her side effects, including chills and weakness. She sought the opinion of two doctors, who determined she didn’t have any heart problems that required a pacemaker.
