Texas THC Ban Unlikely to Take Effect, State Justices Signal

Consumable THC products will remain legal in Texas unless a federal law bans them later this year, some justices on the state supreme court signaled during oral arguments Wednesday.

Vendors appeared to convince the court they have standing to challenge a 2021 finding from a state agency that listed most types of THC as banned controlled substances, limiting the products they can lawfully sell.

“They think it changed something so they altered their behavior,” Justice Brett Busby said.
