Pasadena Refinery System Inc, won’t have to face a lawsuit brought by the employee of a contractor who fell 13 feet while trying to perform maintenance work for the refinery, after a Texas appeals court reexamined its prior ruling.
The contract between PRSI and 3-Ryan—the contractor that performed a maintenance project—didn’t provide a basis for imposing a duty of care on the refinery. Plus the injured worker failed to show evidence the company had prior knowledge of the dangerous scaffolding condition, the Texas Court of Appeals, First District said withdrawing its May 10 opinion.
