Texas Pete Hot Sauce Maker Still Faces Origin-Deception Suit

Texas Pete hot sauce maker T.W. Garner Food Co. can’t avoid a consumer deception suit alleging its Lone Star State-themed products really come from North Carolina.

The name, combined with labels featuring a white lone star reminiscent of the Texas state flag and a cartoon image of a cowboy throwing a lasso, could make consumers think Texas Pete products are made in Texas, a federal court said.

Named plaintiff Phillip White alleged he overpaid because the hot sauce comes from Winston-Salem, N.C. He raised plausible claims under California consumer protection laws, as well as warranty and unjust enrichment claims, Judge ...
