A Texas law that requires food producers to place warning labels on products that contain 44 listed ingredients is unconstitutional, a complaint filed by food industry groups in federal court says.
The American Beverage Association, the Consumer Brands Association, the National Confectioners Association, and Food Marketplace Inc., told the US District Court for the Western District of Texas that Texas’ law is preempted because it undermines the US Food and Drug Administration’s uniform regulatory regime for food labels and that it compels speech in violation of the First Amendment.
