The indictment of a Texas man who was charged with aggravated assault in 2012 was properly dismissed because his right to a speedy trial had been violated, a state court of appeals affirmed Tuesday.
A grand jury indicted Marco Antonio Moreno on April 18, 2012, for aggravated assault with a deadly weapon and an unrelated possession of a controlled substance charge. More than seven years later, and after being released on parole for the possession conviction, Moreno moved to set aside the assault indictment with prejudice for violating his Sixth Amendment right to a speedy trial.
