Texas public library patrons urged a federal appeals court to uphold a judge’s ruling ordering 17 book titles restored to general circulation while their constitutional challenge proceeds.
The lower court judge properly found that the plaintiffs are likely to succeed on the merits of their lawsuit, they said in a brief to the US Court of Appeals for the Fifth Circuit.
Leila Green Little and six others sued LLano County Library System and county officials in 2022. The patrons said removal of the books—many of which have LGBTQ+ or racism-related themes—violated their First Amendment right to receive information.
