Judge Recuses in Texas Tech Quarterback’s NCAA Eligibility Suit

A Texas judge has recused himself from deciding if Texas Tech’s suspended quarterback Brendan Sorsby can play this upcoming season.

Judge Phillip Hays, who holds two degrees from Texas Tech and grew up nearby, said he won’t preside over the case in a one-page recusal order that didn’t give a reason Wednesday.

Hays’ replacement will be picked by the presiding judge in the administrative judicial region that includes Lubbock, Texas, where Sorsby sued the NCAA this week. Ana Estevez, the presiding judge, holds no degrees from Texas Tech.

Sorsby, one of the top quarterbacks in college football, is seeking an injunction that would prohibit the governing body from interfering with his ability to practice or play in what would be his final season in college. He’s currently suspended by Texas Tech because he bet on sports in violation of NCAA rules. The NCAA has yet to weigh in on his eligibility.

The case is Sorsby v. National Collegiate Athletic Association, Tex. Dist. Ct., No. DC-2026-CV-0791, 5/20/26.
