The state of Texas urged a federal appeals panel Monday to vacate a $100,000 a day fine for its foster care shortcomings while advocates contended that the sanction is constitutional and the state has had years to remedy its deficiencies.
Texas was subjected to the sanctions after they failed to comply with a district court’s remedial order addressing allegations that the Lone Star State failed to urgently investigate complaints of child abuse in its foster care system. But the US Court of Appeals for the Fifth Circuit indefinitely stayed the sanctions in May.
