The disqualification of Hicks Thomas LLP from a 16-year-old case may be the only way to fix an undisclosed conflict of interest, a Texas Supreme Court justice said, after one of the firm’s paralegals previously worked on the litigation for the opposing party.
During oral arguments Tuesday, Justice Evan Young said that although he believes the paralegal never shared confidential information with her new teammates, disqualification may be needed to ensure the party represented by the prominent Texas firm isn’t given an unfair advantage.
“I’m not sure it’s the test,” Young said on whether the paralegal improperly disclosed information.
