Texas Election Integrity Law Challenge Weakened but Can Proceed

A challenge to a robust election integrity law Texas Republicans passed after the 2020 election can proceed, a federal appeals court ruled Wednesday, finding that Secretary of State Jane Nelson (R) lacks immunity against some provisions it says her office enforces.

By a 2-1 vote, a panel on the US Court of Appeals for the Fifth Circuit affirmed in large part a lower court ruling that allowed voters rights groups to take on the Election Protection and Integrity Act of 2021.
