Texas Doctor Beats Suit Over Removing Patient’s Breathing Tube

A Texas doctor defeated a claim that she intentionally deprived a patient of his life without due process of law when she removed his breathing tube without consent, resulting in his death.

Theresa Duane’s evidence showed that she decided, based on her medical judgment, to extubate Berman de Paz-Martinez because the procedure was medically indicated and appropriate, the US District Court for the Northern District of Texas said. De Paz’s parents, the plaintiffs in the case, offered no expert medical testimony to contradict her or show that she intended to end his life, it said.
