Texas County District Wins Territorial Annexation Lawsuit Appeal

An emergency service district in Texas escaped a lawsuit brought by the city of Huntsville over the annexation of territory the ESD says was within its jurisdiction because the act was lawful.

Huntsville’s consent was only required when an emergency services district was created, not when one expands, the Texas Court of Appeals, Tenth District said Wednesday, reversing the trial court’s order denying the ESD’s motion to dismiss.
