Texas County Beats Resident’s Suit Over Solar Power Plant Grant

Hopkins County, Texas defeated a resident’s claims that the county hadn’t complied with the requirements of the local government code when it got into an agreement with Hopkins Energy LLC to bring a solar power plant project into the area.

The county’s contract with the company wasn’t a tax abatement program, but instead a grant because the company would still have to pay property taxes each year and make sure it created two full-time jobs, the Texas Court of Appeals, Sixth District said Wednesday, affirming the trial court’s judgment.
