Texas Business Court Allows Removal After Dollar Minimum Change

Learning new case-specific facts isn’t needed to remove a dispute to the Texas Business Court so long as the amount-in-controversy satisfies a new $5 million threshold, a judge ruled.

A change in law that reduced the amount from $10 million equals discovery of new information the court requires for jurisdiction, Texas Business Court Judge Jerry Bullard said.

“To conclude otherwise would contradict the Legislature’s intent and effectively dissuade parties from removing cases with less than $10 million in controversy to the Business Court,” Bullard wrote in the Dec. 5 opinion.
