A new Texas law banning the sale of e-cigarettes containing ingredients manufactured in China will take effect next week as planned, a federal judge ruled Wednesday.
During an emergency hearing scheduled just two days in advance, Judge Keith Ellison of the Southern District of Texas said “I haven’t had any time” to form a judgment on whether the law infringes on the federal government’s authority to regulate commerce.
“It’s unfair to give attorneys such little notice,” Ellison said in denying a request for a temporary restraining order from the bench.
