Texas Ban on China-Made Vape Products Targeted in Industry Suit

A Texas state law banning the sale of e-cigarettes containing ingredients manufactured in China is unconstitutional, a group of vaping companies claim.

The statute is an “impermissible exercise of state power in a realm reserved for the federal government” under the US Constitution’s foreign commerce clause, the Vapor Technology Association and several Texas-based e-cigarette retailers alleged in a complaint filed Wednesday in the US District Court for the Southern District of Texas.
