Teva Appealing Loss to Eli Lilly Over Headache Medicine Patents

Teva Pharmaceuticals Int’l GmbH filed a notice of appeal concerning a judge’s ruling that nixed a $177 million patent verdict in its favor.

A jury ruled against Eli Lilly and Co. in the trial at the US District Court for the District of Massachusetts, with the company arguing that its Emgality migraine drug didn’t infringe related patents for Teva’s Ajovy drug. Judge Allison D. Burroughs issued a judgment as a matter of law, saying the drugs were different “in multiple respects” and that Teva’s patents lacked adequate written description and enablement.
