Tesla Laboratories Inc. has succeeded in its bid to reverse a Defense Department weapons testing award made to a competitor, Universal Technical Resource Services Inc.
The US General Services Administration must scrap its award to UTRS and reevaluate proposals it received to re-perform its “price reasonableness” analysis and best value determination, said Judge Zachary N. Somers in an opinion for the US Court of Federal Claims.
During the procurement and this litigation, “the government made just enough mistakes that its award was nevertheless irrational in a manner that prejudiced Tesla,” Somers said.
