A former Terminix Pest Control Inc. employee failed to show that she was fired due to her disability and in retaliation for not getting a Covid-19 vaccination, a federal judge ruled.
Judge Jane Triche Milazzo granted Monday Terminix’s motion to dismiss Jennifer Hughes’ amended complaint because she failed to state a viable claim under the Americans with Disabilities Act. Hughes’ amended complaint didn’t explain how her rheumatoid arthritis—an autoimmune condition—directly affected her ability to work in any job, how it inhibited her movement, or caused her any pain, the judge said.
