Tennessee Nursing Home Succeeds in Excluding Expert Testimony

A Virginia doctor was properly excluded from serving as an expert witness in a lawsuit accusing a Tennessee nursing home of medical malpractice, a federal appeals court said.

Federal Rule of Evidence 702 requires federal trial courts to determine if an expert’s testimony is relevant, and—under Tennessee law—only an expert familiar with the local standard of care can testify in a medical malpractice case, the US Court of Appeals for the Sixth Circuit said Monday.

The court affirmed the dismissal of Chapelle Gales’ suit against Allenbrooke Nursing and Rehabilitation Center LLC, where her mother, Ellen Ranson, died in November 2020. ...
