Tennessee Construction Company Narrows Worker Data Breach Suit

A Tennessee construction company narrowed a proposed data breach class action from a former worker who said it failed to sufficiently protect his data from cybercriminals.

The alleged privacy harm and the increased risk of identity theft as a result of the breach are sufficient to advance a negligence claim against Wright Brothers Construction Co., according to the US District Court for the Eastern District of Tennessee. The court also let the worker move forward with a breach of contract claim arguing that his employer made an implied agreement to protect his data.
