Tax Firm Fights Allegation Its Arbitration Clauses Are Ambiguous

Clients of a Florida-based tax law firm should be forced to arbitrate their malpractice and fee-related allegations because they are bound by the terms of their retention letters, the firm said.

J. David Tax Law Firm LLC’s clients were attempting to “impute ambiguity” into arbitration clauses they had already agreed to, the firm said in its Nov. 24 reply brief. The clients argued that J. David’s contract was ambiguous, and should therefore be construed against the drafter.
