Tata Consultancy Services Ltd. must face a retaliation claim from a whistleblower who alleges the company deprived the US government of funds by misrepresenting its foreign workers seeking visas.
The district court erred when it dismissed Anil Kini’s retaliation claim because he sufficiently pleaded that Tata, an India-based IT services company, retaliated against him despite being aware that he had engaged in protected conduct, said a split three-judge panel. The US Court of Appeals for the DC Circuit reversed the dismissal of the retaliation claim and remanded the case Friday.
