Target Gets ‘Barkful’ Dog Food Brand’s Trademark Claims Trimmed

Target Corp. convinced a federal court to cut back a majority of a dog food producer’s trademark infringement suit alleging the retailer’s “Kindfull” pet food line ripped off its branding.

Barkful LLC founder Kiara Fernandez-Bravo’s infringement and trade dress claims failed because her trademark had lapsed and she failed to show how her brand was inherently distinctive in the pet food market, the US District Court for the District of Minnesota said in an opinion partially dismissing Barkful’s case. ...
