Talkiatry Patient Can Push California Privacy Claims, Court Says

Talkiatry Management Services LLC will face an anonymous patient’s California privacy claims, after a federal court rejected the mental-health treatment provider’s bid to dismiss them from a proposed class action.

It’s sufficiently plausible Talkiatry should’ve known Meta Platforms’ Pixel would track visitor actions and use the transmitted health-related information for advertising purposes, according to the order from the US District Court for the Central District of California. And it’s possible the Pixel is a pen register—subject to regulations in the state—because it collected location data, Judge Sunshine S. Sykes said.
