Facial recognition technology software design data, source code, and algorithms must be turned over by New Jersey in a first-of-its-kind appeals court ruling that pits police use of artificial intelligence against a defendant’s right to a fair trial.

Prosecutors’ refusal to turn over the identity, design, specifications, and operation of the technology was a violation of an alleged robber’s rights to access potentially exculpatory evidence he could use to contest two eye-witness identifications, the Superior Court of New Jersey Appellate Division ruled Wednesday in a groundbreaking case.
