Sunoco Supplier Can’t Block Gas Station From Changing Brands

A gas station may change brands despite an existing agreement with a Sunoco LP supplier after a federal judge said blocking the change doesn’t serve the public interest and would unfairly hurt the station.

Even if the supplier is likely to succeed on a deceptive mark claim, Judge Joseph F. Leeson Jr. of the US District Court for the Eastern District of Pennsylvania said that it couldn’t satisfy all the factors required to issue an injunction blocking the change.
