Suit Over Offensive Music at Work Sees Joint Dismissal Filing

Wholesale apparel distributor S&S Activewear LLC filed a joint stipulation to dismiss a lawsuit, together with former employees who alleged that sexually graphic and misogynistic music created a hostile work environment at its Reno, Nev., warehouse.

The workers said that the music by artists like Eminem and Too $hort served as what the Ninth Circuit described as “a catalyst for abusive conduct by male employees.” The US District Court for the District of Nevada dismissed the case, but the appeals court vacated the ruling, saying the workers stated a plausible claim of sexual harassment that wasn’t “‘fatally flawed.’”
