Suit Alleging UPS Violated ‘Yelp Law’ Moved to California Court

A proposed class action alleging UPS violated California’s law prohibiting anti-disparagement clauses in business transaction contracts belongs in state court, a federal judge ruled.

The plaintiffs lack the necessary Article III standing to challenge United Parcel Service of America Inc.'s inclusion of a non-disparagement clause in district court, said Judge Dale S. Fischer in an order Tuesday for the US District Court for the Central District of California. “In absence of standing, remand is mandatory,” Fischer said, granting the proposed class’ motion to remand the suit.
