Subway struck back at a proposed class action over its tuna wraps and sandwiches, telling a California federal court that the consumers abandoned their “no tuna at all” theory, and their new challenges based on the tuna’s sourcing show “callous indifference” to the facts.
In January, the consumers alleged Subway Restaurants Inc.'s tuna products were “a mixture of various concoctions” that weren’t tuna.
“After Subway painstakingly provided the plaintiffs’ lawyers with evidence demonstrating the quality and sourcing of Subway’s tuna products, and the fact that the tuna was in fact tuna,” the consumers quickly abandoned their initial theory, Subway said. ...
