Subway ‘Fake Tuna’ Plaintiff Seeks to Voluntarily Drop Suit (1)

A Subway Restaurants Inc. patron alleging the chain misleads customers about the tuna in sandwiches and wraps has asked a federal judge to let her voluntarily drop the suit for now, because unforeseen pregnancy-related health issues have made it impossible for her to pursue it.

Nilima Amin sued in the US District Court for the Northern District of California, alleging Subway’s offerings don’t have real tuna. The first two proposed class suits were dismissed, but some claims in Amin’s third pleading attempt survived last July.
