A Nebraska student whose high school kicked him out for making lewd remarks about a teacher failed to plausibly allege sex bias or Title IX administrative failures, the Eighth Circuit said Wednesday.
The high schooler identified some possible errors in Creighton Preparatory School’s conclusions about the incident, but he didn’t sufficiently link the purportedly erroneous outcome to sex-based discrimination, and there’s no private right of action allowing him to enforce a regulation on Title IX grievance procedures, the US Court of Appeals for the Eighth Circuit said.
