Strip Club Knocks Out Lawsuit Over Unnamed Models’ Use in Ads

A gentlemen’s club’s use of unnamed models’ likenesses on their social media doesn’t raise trademark or false advertising concerns, the Second Circuit ruled Friday.

Plaintiffs are women who once or currently work as professional models and for the most part rarely worked in New York.

The Newburgh, NY-based Mansion Gentlemen’s Club & Steakhouse hired a third party contractor who, the club said, used unauthorized and revealing photographs of the models to advertise the venue, sometimes using pictures that showed their full faces, implying that a customer would see them there.
