A federal judge in Texas must rescind an order authorizing notice of a Fair Labor Standards Act collective of exotic dancers, because some of the potential opt-in plaintiffs involved in the wage lawsuit signed arbitration pacts, a divided Fifth Circuit ruled Tuesday.
The dancers sued Heartbreakers Gentleman’s Club and its owners, alleging that they lost out on wages and benefits because they were misclassified as independent contractors.
