Storm Team Construction Inc. brushed off claims that it “fraudulently represented” to the US Patent and Trademark Office that storms aren’t a significant feature of its services in order to obtain the word mark “Storm Team Construction,” and the design mark for its logo.
Stormz USA LLC sought cancellation of Storm Team’s word and design trademarks in counterclaims, responding to Storm Team’s trademark infringement claims against Stormz.
But Stormz failed to show that the marks were obtained fraudulently, Judge John E. Steele of the US District Court for the Middle District of Florida said Thursday.
