Stellantis Workers Successfully Make FLSA Overtime Pay Claim

Workers at FCA US LLC facilities from three states sufficiently pleaded that the automobile maker failed to pay them proper overtime wages, a federal judge ruled.

FCA, also known as Stellantis, improperly attacked the merits of the claims of the proposed FLSA collective action while seeking dismissal, Judge Linda V. Parker said, instead of addressing whether the workers adequately alleged that the company failed to incorporate bonuses into their overtime pay calculations, alongside failing to pay overtime at 1.5 times their base rate.
