States Clear Jurisdictional Hurdle to Sue NIH Over Grant Cuts

A coalition of states can move forward with their lawsuit alleging the Trump administration is illegally canceling research grants funding medical and scientific advancements, a district court ruled Monday.

The US District Court for the District of Massachusetts has subject matter jurisdiction to hear the legal challenge from 16 Democratic-led states, Judge William G. Young said in a memorandum and order. Young rejected the US’ argument that a recent stay granted by the US Supreme Court strips the district court of jurisdiction since it must be heard by the US Court of Federal Claims under the Tucker Act.
