A group of Afghan asylees who aided the US military during its engagement in that country sued the State Department on Tuesday, challenging its application of a presidential proclamation preventing their family members abroad from entering the US.
The US Department of State is unlawfully denying entry to their spouses and children despite their having approved petitions for derivative asylum status, the asylees allege in a complaint. They say the department is unlawfully applying President Donald Trump’s Proclamation 10949—which restricts entry from 12 countries, including Afghanistan—despite its exemptions for individuals granted asylum.
