An ex-Iowa Toyota dealership worker succeeded in reviving his suit alleging the dealer failed to follow statutory requirements when it fired him for not completing a random drug test.

Scott Hampe is entitled to summary judgment on his claim that Charles Gabus Motors Inc.—doing business as Toyota of Des Moines—violated state law, since the company didn’t substantially comply with the statute’s requirements that the pool of employees to be selected for drug testing exclude those who aren’t scheduled to work that day, Justice David May of the Iowa Supreme Court wrote in an April 11 opinion.
