Spirit Ex-Employees Lose Class Age Bias Appeal Over Job Cuts (1)

Former Spirit AeroSystems Holdings Inc. employees lack evidence of a pattern of intentional age discrimination in a 2013 workforce reduction at a Kansas plant, the Tenth Circuit ruled Tuesday.

Some evidence of statements by Spirit executives and others might support a finding of bias by some managers or higher-ups under the Age Discrimination in Employment Act, a unanimous panel said. “But the combination of evidence doesn’t create a reasonable inference” that Spirit had a standard procedure of shedding older employees, the panel said.
